III. K. Policy on AIDS-Infected Employees
The West Warwick School Committee is committed to the provision of a healthful environment for its employees.
In fulfillment of that commitment, the Committee has and will continue to seek guidance from appropriate medical, educational, legal, and government authorities. This policy statement is the result of such guidance.
AIDS is an acronym for acquired immune deficiency syndrome. As used in this policy, AIDS includes all infections caused by the human T-lymphotropic virus, Type III (HTLV-III), also called lymphadenopathy-associated virus (LAV) and includes acquired immune deficiency syndrome (AIDS), AIDS related complex (ARC) and asymptomatic infections of these viruses.
This policy will apply to all employees in all programs conducted by the West Warwick School District.
Management of the school district for this disease will be the responsibility of the Superintendent of Schools.
If a school employee has been diagnosed as infected with HTLV-III/LAV and reports that diagnosis to the Superintendent of Schools, the Superintendent will convene a team comprising the employee, the employee’s immediate administrative supervisor, his or her physician, an advocate of the employee’s choice, the West Warwick School Physician, and a representative of the Rhode Island Department of Health. The team will review the medical recommendations.
If the team concludes, based on a recommendation by the Department of Health, that the employee should remain in his or her regular job, the Superintendent of Schools will be so informed.
If the team concludes that, based on a recommendation by the Department of Health, that the employee should be removed from contact with others, the Superintendent of Schools would be so informed. The employee would be granted medical leave as stipulated in the appropriate collective bargaining agreement.
